This document aims to inform you how COGNIDATA obtains, uses, stores and protects the personal data it collects.

COGNIDATA, registered with CNPJ under no. 44.443.607/0001-11 and headquartered at Rua Almirante Lamego, nº 747, Room 102, CEP 88.015-600, Florianópolis, SC, Brazil, takes your privacy and the protection of your data seriously. This document explains how we handle your personal data, what your rights are and how you can exercise them. 

​The edition, publication and compliance with this Policy are measures taken by COGNIDATA to comply with Law n°. 13.709/2018 (the “LGPD”) e n° 12.965/2014 ("Internet Civil Framework").

 

GENERAL ASPECTS

As general aspects for a better understanding of this policy, we highlight:

  1. CAPTURED DATA – are those data captured by COGNIDATA directely from the internet (public information).

  2. PROVIDED DATA - is the data that is provided to COGNIDATA directely by website visitors or used for its services.

  3. PERSONAL DATA - is any information related to an indentified or identifiable individual, including identificated numbers, location data, electronic identifiers, or any data that, when combined with other information, is capable of identifying someone, making them indentifiable, or, furthermore, individualize it.

  4. LEGAL BASES - are the legal hypoteses that authorize COGNIDATA and its costumers to process Personal Data. Any and all processing of Dados Pessoais is considered valid if it is based on a legal basis.

  5. TREATMENT – means the uses that COGNIDATA makes of Personal Data (collection, registration, storage, organization, consultation, use, disclosure, sharing, transmission, classification, reproduction, processing and evaluation)

  6. DATA HOLDER - is the person whom the Personal Data are related

 

This document may be improved and updated at any time, with the aim of making it more clear and accessible or as a result of changes in company policies. Therefore, we recommend a regular visit to this page.

 

DATA CAPTURED BY COGNIDATA

COGNIDATA is a technology company for business. We use the data to generate information that can help our clients in making decisions and generating knowledge for their sector. Through BIG DATA ANALYTICS technologies, we help our customers (companies) to analyze the market, understand the competition and offer their products and services with greater assertiveness. We understand that with this, in addition to helping our customers, we contribute to the entire development of the region, whether in economic development with the generation of jobs and income, or by stimulating competition and innovation, encouraging the end customer to have access to better products. and new technologies with the best cost-benefit ratio possible.

For this to happen, COGNIDATA depends on the collection and use of data from legal entities (companies) and contacts (individuals) that are related to the companies (such as partners, administrators, managers and technicians responsible for specific areas). We collect data from public sources (available on the internet), always ensuring the security and privacy of data subjects, respecting and guaranteeing the right to choose in accordance with current legislation.

The development of our solutions is based on two sources. The first is the information that is made public by the different entities that make up the direct and indirect public administration of the Brazilian federative entities, especially the information disclosed based on the Law on Access to Information (Law n.º 12,527/2011) and other acts regulations that make up the Federal Government's open data policy, as well as other publicly accessible data from non-governmental sources, such as class councils (Federal Council of Medicine, Council of Dentistry, Board of Directors, among others). The second is data controlled by customers or partners. In these cases, COGNIDATA acts within the strict limits of current data protection legislation and in accordance with instructions from the controller, who in turn is the one who determines the directions for data processing, as well as the legal basis used.

In this way, COGNIDATA can collect and process the following data categories:

  1. Company Data: number of employees, sector of operation, telephone number, address, city, state, e-mail;

  2. Contact data, such as name, social security number*, date of birth and addresses;

  3. Professional data, related to the professional registration in the professional body;

  4. Corporate data, such as companies with equity interest and other information related to companies, among others;

  5. Macroeconomic and sectoral indicators.

 

The data processed by COGNIDATA, will always be used, but not limited to:

  1. Market and competition analysis;

  2. Expansion and Sales Qualification, and;

  3. Result optimization.

 

In summary, the use will be focused on the identification of companies and people (partners, directors, managers, coordinators, etc.), located in certain regions chosen by our clients so that they can analyze the market, offer their products or services and seek solutions that improve the organization's performance.

DATA PROVIDED TO COGNIDATA FROM THE WEBSITE

For some requests on the COGNIDATA website (scheduling meetings, market studies, etc.) and while browsing the website, we may collect:

  1. Contact data, such as name, telephone number, area of expertise, email, among others;

  2. Company data, such as CNPJ, number of employees, estimated revenue, among others

 

While browsing, we may automatically collect the following data:

  1. Location data: geolocation data when you access the website;

  2. Browsing data: information about your visits and activities, including the content you view and interact with, information about the browser and device you are using, your IP address, your location, the address of the website from which you it arrived.   3. Anonymous or Aggregated Data: Anonymous responses to surveys or anonymous and aggregated information about how the site is used

 

We use cookies and/or similar technologies on our website. When you access the COGNIDATA website, it may store or retrieve information in your browser, mainly in the form of cookies. This information usually does not directly identify you, but it can provide you with a more personalized internet experience by helping us understand your preferences and is primarily used to make the website work as you expect.

Pursuant to this Privacy Policy, we and our third-party service providers, with your consent, may collect your Personal Data in a variety of ways, including but not limited to:

  1. Through browser or device: Some information is collected by most browsers or automatically through Internet access devices. We may use this information to ensure that the website functions properly;

  2. Use of cookies. Cookies are information stored directly on the computer you are using. Finally, it should be noted that the data related to your interaction with the Site will be used to improve our products, making your experience with COGNIDATA even more peculiar.

 

DATA SHARING BY COGNIDATA

Our objective is to help our clients in the analysis of the market and competition, in the expansion of sales and in the optimization of results in order to supply their products or services, in this way, we can share their data with the clients, adopting techniques for maintaining high standards of security, when possible anonymously, seeking your privacy as much as possible. Below we describe in which situations personal data is shared:

  1. With COGNIDATA service providers and technology providers. Some suppliers that we need to hire may handle the personal data we collect. Examples of this are companies that provide data hosting and registration validation services. We emphasize that any data shared with suppliers is carefully evaluated and contracted so that the obligations of information security and protection of personal data are maintained, thus reducing the risk for the holders.

  2. With our customers. Sharing information to generate knowledge about markets to make your products or services available is our reason for existence. In this way, the data collected on the various platforms of public administration companies, professional entities and partners, are shared with our customers in order to help them in market and competition analysis, in expanding sales and in optimizing results.

  3. Cloud data storage: data is stored using Microsoft Azure Cloud services, following a high degree of security and reliability in processing operations.

 

Finally, we reserve the right to share any Personal Data that we believe is necessary to comply with a legal obligation if required by an authority with legal competence.  

 

PERSONAL DATA HOLDER RIGHTS AND HOW TO EXERCISE THEM

Your Personal Data are yours and Brazilian law guarantees you a series of rights related to them. COGNIDATA is committed to the fulfillment of these rights and we guarantee an exclusive channel for you to contact us.

For the exercise of the rights granted to holders of personal data under the General Data Protection Law - Law 13.709/2018, the data subject or their legal representative can make their request by sending an email to dpo@cognidata.com.br.

The request will be answered immediately, or within a maximum period of 15 (fifteen) days, pursuant to art. 19 of Law no. 13,709 (LGPD), unless otherwise required by law or otherwise provided by the competent authority.

In cases where COGNIDATA, acting as Operator, receives a request from a Data Subject, it will redirect the request to the respective Controller, so that the request is answered within the legal deadline.

By e-mail: dpo@cognidata.com.br, you will be able to find out if COGNIDATA has data about you, request its deletion (totally or partially) or even request correction. It should be noted that for your security, whenever you present a request to exercise your rights, the Company may request some additional information and/or documents so that we can prove your identity, thus minimizing the risk of fraud and guaranteeing everyone's safety and privacy. 

The retention of personal data by Cognidata is in line with current legislation, and they are only stored for as long as necessary to fulfill the purposes for which they were collected, unless there is any other reason for keeping them, for example , compliance with legal and regulatory obligations, among others, provided they are duly substantiated with a legal basis.

We are responsible for taking care of your Data and using it only for the purposes described in this Policy. To guarantee your privacy and the protection of your Personal Data, we adopt advanced technological resources to guarantee the security of all data processed by the Company. The implementation of access controls to data processing systems and environments, encryption techniques, among other information security controls are medications we take to protect data.

We emphasize that, although we always strive to protect the Personal Data we process, unfortunately we cannot guarantee complete security, especially in the face of malicious acts by third parties. Hardware or software failures that are not under the control of COGNIDATA and other factors may compromise the security of the Personal Data we process.

If you identify or become aware of something that compromises the security of your data, believe that your Personal Data has been used in a manner incompatible with this Policy or with your choices as holder of this Personal Data, or, if you have any questions, comments or suggestions for improving the DATA PROCESSING POLICY, we are at your disposal.
